Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

Upon receipt of a valid DMCA Notice, we will remove or disable access to the allegedly infringing material. We will also take reasonable steps to notify the user who posted the allegedly infringing material of your complaint.

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Elements of a valid DMCA Notice:

  1. Identify the copyrighted work that you claim has been infringed, or—if multiple copyrighted works are covered by this Notice—you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s) on the Sticky Asian Chicken Recipe website where the material can be found).
  3. Provide your mailing address, telephone number, and, if available, email address.
  4. Include both of the following statements in the body of the Notice:
"I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
"I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  5. Provide your full legal name and your electronic or physical signature.

Deliver this Notice, with all items completed, to our Designated Copyright Agent via the contact method provided on our Contact Us page.

Filing a DMCA Counter-Notification

If you believe that the material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us ("Counter-Notice") by submitting written notification to our Designated Copyright Agent identified above. Pursuant to the DMCA, the Counter-Notice must include substantially the following:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., URL(s) on the Sticky Asian Chicken Recipe website).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, telephone number, and, if available, email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Sticky Asian Chicken Recipe may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
  • Your electronic or physical signature.

Deliver this Counter-Notice, with all items completed, to our Designated Copyright Agent via the contact method provided on our Contact Us page.

The DMCA provides that removed material will be replaced or access to it restored in 10-14 business days after receipt of the Counter-Notice, unless our Designated Copyright Agent first receives notice from the person who filed the DMCA Notice that such person has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our system or network.
